TERMS OF PURCHASE OF THE EASYJET FEARLESS FLYER COURSE

Definitions and interpretation

“Online Course” means the easyJet Fearless Flyer Online Course created by FOF Digital Ltd and available for viewing only via a Computer, Tablet, mobile phone or such other similar device.

“easyJet” means easyJet Airline Company Ltd. “Promoter” means the person firm or company staging the Online Course if different from Us.

  1. Price and payment 
    The price of the Online Course shall be the price set at the time we accept your order. All prices set are inclusive of any applicable taxes. No access to Online Course will be available until we have received full payment of the cost of the Online Course.
  2. Delivery  
    You will be given access to our Online Course via a unique login to our members site (which will be sent to you via email) but only once full payment has been made for your own viewing use only. Your MP3 player will be despatched to the registered payment address. Please allow 7 to 10 days for delivery (however please note no mailings will be made during the period 23rd December – 9th January). Please also allow extra delivery time for any purchases made during the month of December.
  3. Refunds
    Our Online Course cannot be refunded after purchase under any circumstances.
  4. Breach of Agreement
    easyJet Fearless Flyer Online Course is copyright protected. It is therefore not permitted to download, record or publish any of its content or your unique login details and to do so is a breach of the terms of use of this agreement and is against the law. Please note that your IP address is linked to your login details and if our tracking system suspects a breach of this statement or of our general terms and conditions then we reserve the right to permanently suspend your access to the Online Course without notice or penalty.
  5. Assignment
    We shall be entitled to assign any of our rights and obligations under these Terms and Conditions provided that your rights are not adversely affected.
  6. Severability
    If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
  7. Third Parties 
    Any person, other than easyJet, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts but in this case only We, FOF Digital, easyJet and You (or your assignees permitted hereby) have rights and obligations under this contract.
  8. Amendments and variations 
    We intend to rely on the written terms set out here in this document.  You should therefore read the terms and conditions carefully before entering into the contract to ensure you are happy to be bound them.
  9. No Partnership or Agency 
    Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.
  10. Advice
    Please do not rely on any information contained within the Online Course as an alternative to medical advice, treatment or care from a medical doctor or other professional healthcare provider.
  11. No Warranties
    The information contained within the Online Course is provided without any representations or warranties, expressed or implied.
  12. Entire agreement 
    These Terms and Conditions and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms and Conditions or not) other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
  13. Governing Law and Jurisdiction 
    These Terms and Conditions shall be governed by and construed in all respects in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts.
